The Climate Energy Law provides for the end of regulated gas and electricity sales prices for professionals. An end that will still be gradual, depending on consumption and the profile of each. Here are some important points to note.
The regulated sales prices correspond to prices set by the public authorities. They have been practiced for years by historic suppliers of electricity and gas. Since January 1, 2016, the largest consumers - subscribed power greater than 36 kVA or annual gas consumption greater than 30 MWh for non-domestic customers or 150 MWh for condominiums - are no longer eligible for these rates. And the 2019 Climate Energy Law further limits eligible consumers to these regulated sales and tariffs for gas and electricity. To see more clearly, professionals can find information, for example, on this site.
For natural gas, all professionals - understand, companies, associations, administrations or communities - are affected from December 1, 2020. For electricity, only certain professional consumers are affected from January 1 2021. Those who employ more than 10 employees or whose turnover, receipts or total annual balance sheet exceed 2 million euros.
The end of regulated electricity tariffs for certain professionals
Since the enactment of the Climate Energy law, the historic suppliers, EDF and ENGIE, have had the obligation to contact their professional customers in order to establish whether or not they remain eligible for TRVs. It is the client’s responsibility to respond using a reply coupon and a pre-stamped envelope. To then choose the market offer best suited to their needs, customers affected by the end of regulated electricity sales tariffs can consult the national energy ombudsman or an electricity comparator.
In the meantime, they will receive three letters to remind them of their obligation to sign, before December 31, 2020, a new contract. The last one in October 2020.
The end of regulated gas prices for all professionals
Since November 2019, it is no longer possible for professionals to sign a contract for TRVs for gas. Professionals who still have a contract for TRVs must organize themselves to sign a new contract as a market offer before November 30, 2020. As with electricity, this obligation will be reminded to them by three letters, the last in September 2020.
Those who have not made the arrangements by the due date - both for gas and for electricity - will automatically switch to a default offer. The professionals concerned will receive, from historic suppliers, the new conditions of their contract at the latest two weeks before the date indicated above of the last reminder letter.
However, professionals are advised to anticipate in order to sign a contract that really meets their needs. Knowing that it is possible to keep your supplier. Or to change it, in which case, it is the new supplier who takes charge of all the administrative procedures related to the termination of the old contract free of charge.
